This Agreement is between you (“User”) and Erik Nascimento / Binge (“we”, “us”) and governs your use of the Binge application (“App”). By downloading, accessing or using the App, you accept this Agreement. If you do not agree, do not use the App.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on your devices in accordance with the applicable App Store / Google Play terms. You may not copy, modify, distribute, sell, rent, or reverse-engineer the App except as permitted by law.
You are responsible for your account, for keeping your credentials secure, and for all activity under it. You must be of the minimum legal age to consent to data processing in your jurisdiction.
The App lets you post content — comments, reactions, username, profile photo and other material (“User Content”). You are solely responsible for the User Content you post and represent that you have the rights necessary to post it.
We enforce a zero-tolerance policy for objectionable content and abusive behavior. You must not post or engage in: harassment, threats, bullying or incitement to hatred; sexually explicit, violent, illegal content, or content that exploits minors; discriminatory speech based on race, ethnicity, religion, gender, sexual orientation, disability or origin; spam, fraud, abusively unmarked spoilers, or impersonation; or any content that infringes third-party rights or applicable law. By posting, you agree to these rules.
We may suspend or terminate your access, with or without notice, for a breach of this Agreement. You may stop using the App and delete your account at any time in Settings.
The App is provided “as is”, without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App or from third-party User Content. TV and movie data is provided by TMDB; the App uses the TMDB API but is not endorsed or certified by TMDB.
Your data is handled per our Privacy Policy.
This Agreement is between you and us only, not Apple. Apple is not responsible for the App or its content and has no obligation to provide support. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); otherwise Apple has no other warranty obligation. Apple is not responsible for claims relating to the App (including product liability, legal/regulatory compliance, or intellectual property). Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you. You represent that you are not in a U.S.-embargoed country and not on any U.S. Government prohibited-parties list.
This Agreement is governed by the laws of Portugal, without prejudice to your mandatory consumer rights. Disputes are subject to the competent courts of Portugal.
We may update this Agreement. Continued use after changes constitutes acceptance of the revised version.

Este Contrato é celebrado entre ti (“Utilizador”) e Erik Nascimento / Binge (“nós”), e rege o uso da aplicação Binge (“App”). Ao transferir, aceder ou usar a App, aceitas este Contrato. Se não concordas, não uses a App.
Concedemos-te uma licença pessoal, limitada, não exclusiva, intransmissível e revogável para usar a App nos teus dispositivos, de acordo com os termos aplicáveis da App Store / Google Play. Não podes copiar, modificar, distribuir, vender, alugar nem fazer engenharia reversa da App, salvo quando permitido por lei.
És responsável pela tua conta, por manter as credenciais seguras e por toda a atividade realizada através dela. Deves ter a idade mínima legal para consentir no tratamento de dados na tua jurisdição.
A App permite publicar conteúdo — comentários, reações, nome de utilizador, foto de perfil e outro material (“Conteúdo do Utilizador”). És o único responsável pelo Conteúdo que publicas e garantes que tens os direitos necessários para o fazer.
Aplicamos uma política de tolerância zero a conteúdo censurável e a comportamentos abusivos. É proibido publicar ou praticar: assédio, ameaças, bullying ou incitamento ao ódio; conteúdo sexual explícito, violento, ilegal ou que explore menores; discurso discriminatório com base em raça, etnia, religião, género, orientação sexual, deficiência ou origem; spam, fraude, spoilers não marcados de forma abusiva, ou personificação; ou qualquer conteúdo que viole direitos de terceiros ou a lei aplicável. Ao publicar, concordas com estas regras.
Podemos suspender ou terminar o teu acesso, com ou sem aviso, em caso de violação. Podes deixar de usar a App e eliminar a tua conta a qualquer momento nas Definições.
A App é fornecida “tal como está”, sem garantias. Na máxima medida permitida por lei, não somos responsáveis por danos indiretos, incidentais ou consequenciais decorrentes do uso da App ou de Conteúdo de terceiros. Os dados de séries e filmes são fornecidos pela TMDB; a App usa a API do TMDB mas não é endossada nem certificada pelo TMDB.
Os teus dados são tratados conforme a nossa Política de Privacidade.
Este Contrato é apenas entre ti e nós, não com a Apple. A Apple não é responsável pela App nem pelo seu conteúdo e não tem obrigação de prestar suporte. Em caso de falha de garantia aplicável, podes notificar a Apple, que reembolsará o preço (se aplicável); salvo isso, a Apple não tem outras obrigações de garantia. A Apple não é responsável por reclamações relativas à App. A Apple e as suas subsidiárias são terceiros beneficiários deste Contrato e podem fazê-lo cumprir contra ti. Declaras não estar num país sob embargo dos EUA nem em listas de partes proibidas do Governo dos EUA.
Este Contrato rege-se pela lei de Portugal, sem prejuízo dos teus direitos obrigatórios de consumidor. Os litígios são submetidos aos tribunais competentes de Portugal.
Podemos atualizar este Contrato. O uso continuado após alterações constitui aceitação da versão revista.
